Should Eminent Domain Laws Be Changed?

In the wake of a U.S. Supreme Court ruling that says that governments can seize private property for private development -- not just public use -- the state of New Hampshire is considering several bills that would more tightly restrict when the government can take land.
The bills would allow the state to only take private land (in exchange for fair-market compensation) for public use, so economic development, higher tax revenues or more jobs can't become reasons for the government to take land from private owners without their consent.
In addition, some advocates are calling for the state to seize land owned by Justice David Souter and replace it with an inn, to illustrate what they call a poor decision.
What do you think? Should the laws be changed? Or is there a danger that the state could get in legal trouble if it, for example, takes land for a needed road project and ends up selling excess land to a developer?
And what about Souter's land? Are advocates going too far by trying to take it, or is it just following through on a legal precedent the court itself set?

It just amazes me how many freedoms that people are willing to vote away! I hope that the government will not be allowed to take land for private development. people in this country need to wake up and start to pay more attention!

Again, this is your country but to live free or die isn't what it is cracked up to be. If you buy a piece of land the city or town you live in has set rules that you have to abide by or get an ammendment to. It may be your land but you have to abide by what you are told to do.

Lauren Canario is a hero of the people! She is a defender of freedom, and will let nothing stand in her way while she fights for the rights of others. Lauren, who was arrested in New London, Connecticut, for protesting the taking by eminent domain, the property of a friend's house, has stood up to her captors and will not relent her position of being right. Eminent domain has become an ugly abuse of power over the people by the U.S. Government. In recent months, people have stood up to this illegal use of power. Whether it be by votes or protest, people everywhere have had enough of the taking of land by eminent domain. Lauren Canario is at the forefront in this fight against eminent domain, and the right of free speech and protest. Connecticut Judge Kevin McMahon has kept Lauren in prison since September 22, 2006 because of her peaceful protest. McMahon must think that Lauren is a threat to the government that wants to keep it's power over the people. What McMahon and others like him don't realize, is that while Lauren Canario is in jail, there are countless people who are carrying her torch of freedom. The freedom fighters are growing in numbers, and like Lauren, they will not be stopped! I love you Lauren, and stand with you in the name of freedom! As a believer of all those who protest for freedom and the rights of people against the government, I am, George Vreeland Hill.

Very gratifying to see the thing pass with such a big margin. Apparently most of the ballot initiatives in other states either expanded various powers of government or failed. Here we had two, both passed and both limited the authorities, at least indirectly.
Maybe we really are still the Live Free or Die State I just hope we can survive this new dose of one party rule...

At least NH voters have prevented another New London travesty from ocurring with the passing of new Constitutional Ammendment banning private takings for private gain under the guise of municipal economic development.

We the people voted yes to stop the illegal use of eminent domain. We have also had enough of our government and what they are doing with just about everything. Because of what happened on November 7th, there are, and will be, sweeping changes around this country. The entire use of eminent domain should, and will be stopped. The leaders of this country who have gone too far with power (and there are many of them) will be stopped and dealt with as well. I have just begun to fight!! I am, George Vreeland Hill

Eminent Domain, As I learned years ago in High School civics, stated: The seizure of ones property by the government, for the benefit of the community. roughly translated, for rights of way of highways, power transmission lines, municipal pipelines and such community improvement as deemed necessary for the good of the community. Private developement corporations cannot exersize Eminent Domain. If the Supreme Court has ruled otherwise, they have overstepped their authority

A woman named Lauren Ann Canario from Winchester, NH has been arrested for a second time in New London, CT. This time for sitting on a porch of one of the NLDC takings properties from the Kelo Supreme Court Decision.
She has been incarcerated since September 1st with a trial on Oct. 23rd. Since the moderator seems to have deleted previous post. See more detail at nhfree.com.
