Amendment 48, the so-called "personhood" amendment, would define the term "person" to include "any human being from the moment of fertilization" and apply this definition of person to the sections of the Colorado Constitution that protect the natural and essential rights of persons, allow open access to courts for every person, and ensure that no person has his or her life, liberty, or property taken away without due process of law.
Supporters said it would define "person" in Colorado's constitution and provide foundation for protecting every human being at all stages of life including a human being from the moment of fertilization.
Opponents said the amendment would lay a legal foundation to outlaw all abortions in Colorado, even in the earliest weeks of pregnancy, in cases of rape or incest, or when the life or health of the woman is at risk.
